Industrial Tribunal Report launched

MISCO and CIMIRA have just issued the second edition of the Maltese Industrial Tribunal Report. This report has been compiled with the aim of providing senior management and executives with sufficient background information about the Maltese Industrial Tribunal. Compiled over the last two quarters of 2008, this report serves as a reference document for management on the way the Industrial Tribunal has dealt with a number of issues related to employer – employee contractual obligations. This survey is also useful to those organisations that have limited understanding of the Industrial Tribunal and to those companies who need guidance in the eventuality that they need to refer to the Tribunal. The report can also be used as a reference to help avoid disputes and consequent penalties for transgression and as an insight to the alternative routes of dispute resolution that exist.
The report is divided into three main sections. The first part gives a detailed background of the Malta Industrial Tribunal’s role and the way in which it operates. This section also aims at finding out why a case appears in front of the Tribunal, what the Tribunal takes into consideration before delivering a decision, and the award that is granted in due course.
The second part of the report defines a number of disputes which can arise in front of the Industrial Tribunal and which concern either the employer the employee. Interest, Grievance, Legal and Legal disputes are covered in this section.
This third and final part gives a detailed review of some of the most important cases related to unfair dismissal. Warnings, Leave, Negligence, Misconduct and Redundancy are just a few cases discussed in this section.
